Passport for my baby

Hi All,

My husband is doing PhD in germany from 2002 September and from 2008 March he is not get paid. For him, it's about 8 years being here in germany with Aufenthalterlaubnis status in the visa. I came here in 2005 November. I was student till 2008 March and got job in the same month. I am working here for more than 2 yrs. As I read in the rules, I am eligible for NE from next April. My question here is, I am pregnant now and got the due date in April. Will the baby get German passport as my husband lives here more than 8 yrs.

Any ideas please.

STUDENT TIME:
November´2005 to March´2008 = 29 months/2 = 14.5 months

JOB:
March´2008 to June 2010 = 27. months

TOTAL TIME COUNTED FOR NE:
27 + 14.5 = 41.5 months

you still need to work 18.5 months to get your NE.

Due date in April´2010?? coze if you got pregnant now (lets say 1st of June´2010 10:48 am), than in April´2011 the baby will be like 10 months

No your baby does not qualify for German passport, as at the time of birth your husband should have NE(for atleast last 3 years).

BTW why your husband is not getting paid? did he finished his PhD? if not than why? as usually PhDs take upto 4 years in Germany.
