changing jobs

Hi everyone!

I have been working for the same company (as a GC) since 2001. I have found a new job and in the contract they mention a probation period of 6 months. With my current company I had initially a 2 year contract and than was offered the permanent contract. Could anyone explain this probation period to me, since it sounds quite risky to go from a permanent contract to a probation period.

Hi Ciprian,

It is normal in germany for any new employee to go through this probation period whatever your previous experience is. During this probation period the employer has the right to fire you without giving any valid reason and maybe no notice period as well.

It is risky in your present situation, particularly when you are so close to applying for a NE. If at all you lose ur job in the new company ur NE will be in a limbo.

quite strange that you're working in Germany and know nothing about the probation period.

And btw, AFAIK you can't get rid of it, as it is gesetzlich.

6 months is a maximum possible probation period in Germany. usually it's 3 months regardless of your experience

that would be a mistake as it will make employer think that you are somewhat lazy and prefer to have social securities just in case

i would rather prefer to make it 12 months (knowing that it will be 6 months anyway regardless of the amount of months written in a contract ) and ask for a compensation - bigger starting salary

you can if your employer will be stupid and sign a contract without a probation period. your employer - cannot convince any court of law that probation period exceeds 6 months because it is written in a contract and signed by you
