Does one have to wait full five years before applying for NE or can one make the application with one odd month to go?
Problem is I need to travel to the US and Canada for about a month and my present visa(5 yrs) for Germany expires in 4 weeks.

how long will you stay in north america? if less than 4 weeks, why you worry about it?

I need to go for at least a month and when I come back my present visa would have expired!
The people at the foreiegners office are insisting that I need to complete 5 yrs in full even if it means just 2 weeks short!!

it is easy, now what you need to do is to extend your visa for another 2 years (I am sure it is reasonable), when you come back from America, apply NE.
