Re: www.german-green-card.org

Hi Guys, I have just signed up to trust7 to post a link to the same letter basically.

As the author of the topic did not elaborate on the content of the site above, I just wanted to urge you to visit the link still. Russian Green-Card in Germany people have compiled a note for the German policy makers, media and general public. They ask for a decision to be met on what legislation will be applied to our situation once the Green-Card 5 year time frame expires.

Re: www.german-green-card.org

Translation of the above pdf file is

Thank you for the inquiry of 2, March, 2004 to the duration of stopover of sucked. Green Crad owners, whom reached you from the initiative group of the IT specialists. The Federal Government assumes with the entry into force of the Zuwanderungsgesetzes this question is solved durably positively.

The legal bases for the permission of the IT specialists, the IT Argv and It-av, are to cease to apply with the entry into force of the Zuwanderungsgesetzes. Then IT specialists are certified either foreign specialists, after $18 AufenthG to the job market be/will or highly qualified, which are too left after § 19 AufenthG. The circle of acquaintances, which becomes certified after § 18 AfenthG, after five-year occupation and when being present the other conditions after § 9 AufenthG an utterance on distribution of an address permission, which permits each gainful employment.

Also after the valid right the further stay is clearly regulated in the Anschulss to the five-year stay than IT specialist. Already after the existing right the maximum duration of stopover of IT specialists is not limited in Germany to maximally five years. The appropriate regulation of the so-called "Green Card regulation" (It-av), which is interpreted often wrong, means only that the residence permit is limited to five years in the context of this regulation. Subsequently, the further stay determines itself according to the general regulations of the foreigner right; that it means that during a continued employment in this activity the residence permit can be extended.

As far as in the five-year residence time sufficient German Language knowledge were acquired, which is secured living costs and no classification reason is present, the extension of the residence permit does not stand on an unlimited extension of the residence permit. In work going acting like right a request for distribution would be to be examined a work permission for the continuation of the occupation after the general regulations at expiration of the five-year occupation after.

As obligation in accordance with estimation decision at the earliest for August 2005, which can be met - precipitates, is not to be predicted. During continuous work market tendency with the not expecting unchanged of the current right for work market permission a work correction would have to be given.
