I got my Niderlassungserlaubnis
Hi all,
Today I finally got my NE. I will try to summarise my case for anybody who might be interested.
- I am not a GC, I am a telecom engineer working in DE since July2001 with a normal WP/RP.
- My salary till end of May2005 is around 60 K.
- Starting from June2005 I will start a new employment with 85K+ salary.
- Me and my new employer applied for the job change in Jan2005.
- It took about 2 weeks for the AB to say that they will give me a NE according to §19. But it took about 3 months and half for the security check.
- They asked me for my new work contract just at the same time they gave me NE.
- My childeren got an Aufenthaltserlaubnis until they are 16 years old.
- My wife is in DE since August2001, she got a 2 years extension with Erw. Erlaubt, next year in August she can get her NE.
That's all.
Any questions from anybody are welcomed.
By the way, I live in Hessen, 40 Km away from Frankfurt.

P.S - I neither applied for my wife's extension nor my childrens visa. I heard that wife and children will get NE once there are 5 years and how come your children have got till they are 16 years??

Hi Rajesh,
To be honest, I am not sure why my childeren got an Aufenthaltserlaubnis till the age of 16 years. I have applied for all of them (wife and childeren) because all of us had an Aufenthaltserlaubnis until 10/06/2005.
It might help if you know what is written on their Aufenthaltstitel:
§32 - Verl. gem. § 34
If you understand anything from these law paragraphs please let me know.

Hi Wsh,
i think as per §35 if the child is minor and if he he/she has lived in German for 5 years with Aufenthalserlaubnis, he or she/ then is entitled to get NE. I think it also applies to spouse accorind to §32 or 33.
Well 3.5 months for security check is bit too long. It took only 6 weeks in my case( the whole process )
