Working as a Freelance during Vacation
Hello All,
I am an employee with a consulting company. I am working for a third company. Now I have got another job at another company. I want to resign this month. So I have to join at new company from December. I have still resturlaub of 20 days with my present company. So I can take my holidays in full November. But the third company where I am working wants me to work for them in November.
Now my question is : Can I work for this third company as a freelancer (i have Erwerbstätigket gestattet)) for the month of November being in vacation from my present company?
I would appreciate your answer.

Legally you will be working with the present employer until end of November, whether you are in holidays or at work is secondary. If you want to take another employement you may have to get permission from your present employer. Look into your contract for this para where it says about gaining secondary employement.

thank you raj for your response. yes i know that in my contract it's written that i have to take a permission to do a second job inparallel to my current one. but if there is any other possibility to work in November?

Only option AFAIK is to convince your company to let you go from end of this month?
Also be careful of working with your client because there maybe a clause where you are prohibited from working with the client for a particular period of time.

I also have a question about how u will manage the payement from the client? It is very tricky becos you will be starting as a Angestellte in exactly one month. Just take the vacation, enjoy urself and plunge into the new company. Maybe it is not worth to do what u want for a few Euros.

Thank you for your suggestions. But it is not a matter of euros. it's very important for the third company. they really need me atleast until the end of november. i have been involved in the project so much that they will really be in problem if i do not work for them.
any opinion from anybody is welcome!
