I have a new Job and would like to change over. But, as per contract, I have 3 months notice period with my existing employer. The future employer is not ready to wait that long. If I do not serve this notice period, can they take any legal action against me.

I think you can negotiate with your employer. Yes the law maybe says 3 months but you could in principle make an arragement to take 1 month vacation or something of that sort (or that you get off earlier but won't get salary for this).
