Income Tax in case if spouse joins me by Dec 03
Hello,
This is concerning to my Income tax refund for the year 2003.
I got married, Nov the 3rd 2003 and my wife landed in Germany, 24th of Dec 2003. I have changed my tax clause (Steuer Klasse from 1 to 3 on 1st of March 2004).
Few of my colleagues are telling me that my TAX CLAUSE will be considered as 3 for the whole of financial year 2003 and 2004 (Jan and Feb 2004) as my wife landed here on 24th of Dec 2003.
Any one have come across such a situation in this Forum ?.
Will it be possible for me to get the Tax refund from Finanz Amt when i file my tax return for 2003 ?.
Could some one kindly give me more inputs in this regard....

Hi Girish,
I dont know if u r still tracing this thread... but i would like to ask u what happened in ur case... for me also, it is something similar.. my wife landed in Germany on 26th december, 2004 and she was already before in Germany for last 3 years as a student...
did u get the tax refund for 2003 as well??

Hi,
If spouse stays more than six months in a financial year i.e Jan- Dec then entitled to claim tax which ever over paid before spouse joining you. If spouse joins by Dec then it won't be considered for that financial year.

hi,
I got married on 24-12-2002,my wife came in july 2003. With relative marrige document I applied for tax refund 2002 in november 2003 & got tax refund as married for whole 2002. I think if you get tax consultant, he can claim double houshold also(tax consultant suggested me that I could have claimed double householde for 2002 also). Now for 2003 I am applying double household for seven months with tax consultant.

Mind if I tell my experience?
we married in germany in 2001. I applied changed from LK 1 to 3. 2002 I went to tax consultant and I got 3000 back.
he told me that in 2001, we were counted as married couple. Of course my wife didn't work.
