Niederlassungserlaubnis - Daueraufenthalt EG. Anyone got this yet?
Hey guys,
I was wondering if anyone has got the NE with the addendum "Daueraufenthalt EG". I am going there in 2 months and planning on asking for it. I was wondering if there is a precedence already.

Hi!
After reading the complete thread to the end I have some thing to ask:
Having Daueraufenthalt-EG means that we can work within EU (with some exceptions) and still retain or "German PR title aka NE"?
=>Even after 6 months the NE doesnt get void?
=>If we work in UK (offcourse on a UK workpermit),we can anytime come back to Germany and work here again?
I wish any of the above is true-

Daueraufenthalt EG. is not for NON EU people.Not for indians e.t.c.
That is what I was told in my ABH in Bremen.
Please confirm if this is true.
Is it possible to have a statment quote from a law or something which I can show to them

Nach dem geltenden Aufenthaltsgesetz erlischt grundsätzlich jede Aufenthaltsgenehmigung -
also auch eine Niederlassungserlaubnis (ehemals „unbefristete Aufenthaltserlaubnis“) - bis
auf wenige Ausnahmen, wenn sich der Ausländer länger als sechs Monate außerhalb
Deutschlands aufgehalten hat. Diese Vorschrift entspricht jedoch nicht den europäischen
Richtlinien, sofern davon auch Ausländer betroffen sind, die langfristig in den EU-Staaten
aufenthaltsberechtigt sind.
Aus diesem Grund wird das Aufenthaltsgesetz geändert. Der entsprechende Gesetzesentwurf
sieht einen neuen Aufenthaltstitel für langfristig aufenthaltsberechtigten Ausländer vor: Die
Niederlassungserlaubnis-Daueraufenthalt-EG (§ 9 Abs. 3 AufenthG).
Dieser Aufenthaltstitel wird auf Antrag erteilt und setzt voraus, dass sich der Ausländer seit
mindestens fünf Jahren rechtmäßig im Bundesgebiet aufhält und die übrigen Voraussetzungen
für die Erteilung einer Niederlassungserlaubnis erfüllt sind: ausreichendes Einkommen,
Deutschkenntnisse, Straffreiheit etc..
Die Niederlassungserlaubnis-Daueraufenthalt-EG erlischt erst, wenn sich der Ausländer für
einen Zeitraum von zwölf aufeinander folgenden Monaten nicht im Gebiet der europäischen
Union aufgehalten hat. Das bedeutet, dass dieser Aufenthaltstitel nicht erlischt, wenn sich der
Ausländer etwa in Frankreich oder in der Niederlanden für längere Zeit aufhält. Der Verlust
der Niederlassungserlaubnis-Daueraufenthalt-EG tritt in einem solchen Fall erst nach einer
Abwesenheit aus dem Bundesgebiet von sechs Jahren ein (§ 51 Abs. 8 Nr. 4 AufenthG).
Die Inhaber einer Niederlassungserlaubnis-Daueraufenthalt-EG genießen zudem einen
besonderen Ausweisungsschutz, etwa wie Deutschverheiratete.
Anträge auf eine Niederlassungserlaubnis-Daueraufenthalt-EG können erst nach Inkrafttreten
des Gesetzes gestellt werden. Diesbezüglich werden wir gesondert berichten. Da die Frist zur
Umsetzung der europäischen Richtlinie in das deutsche Recht bereits abgelaufen ist, können
sich betroffene Ausländer bereits jetzt auf die dort vorgesehenen Rechte für langfristig
aufenthaltsberechtigten Personen im EU-Gebiet direkt berufen.

This issue is a perfect example how the officials in Ausländerbehörden behave different from each other.
At the moment, so far I can see, caligula in this website is the only person who has the NE+Daueraufenthalt/EG in his passport. More details, please read this thread. AFAIK he has not moved/started to work in another country in EU, to take advantage of 2003/109/EC [1].
Apart from that, coolben was told that he will get gemäß Abs.4 AufenthG und §§ 2-8 FreizügG/EU [2]. Please read that thread. After that he did not feed us. Therefore I think he has not got anything similar to the one caligula got.
2003/109/EC Council Directive opens NE holders to work in EU members signed that the Directive (England, Denmark and Ireland did not). But a NE holder can work only if the said countries (e.g. you have NE in Germany but want to work in Spain) apply the Directive in laws. AFAIK Germany has not done it yet [3]. And also, we don't know any list of countries applied this Directive.
I suspect that caligula's NE title covers 2003/109/EC, although he has that stick on his password. Probably the official did not read the laws correctly. I'm afraid that we have no example, which/who is a "test case" for it.
Please correct me if I'm wrong here.

You are not wrong but I would advice you to follow the "Gesetzänderungen" category of the "info4alien" Forum instead of trying to draw a conclusion from Trust7 posts. Info4alien posts are more reliable and informative in this regard.

The law is not (yet) effective in Germany but it looks like some states startto issue "Daueraufenthalt-EG". At least an ABH-Officer from NRW says that there is a "Vorläufige Umsetzung der Richtlinie" in his state.

Got my NE today in Düsseldorf. I used the case to ask about the Daueraufenthalt EG. The official did not seem to want to deal with this, though the whole thing is on their webpage and I pointed him out a print of it, whereby he lokked and said "here! you see? It is for EU citizens only"...What!? I mean, I can read as much... but anyway... Point is, they either don't know it or don't feel like implementing it. I also did not want to get on his nerves, and just ignored the blatant fact of him talking nonsense. Blame me! I guess one has to wait till this thing gets officially accepted as a law, and perhaps then, there will be no need to state the obvious, either - namely, that whoever has a right of residence in country X of the EU, has the same right in other EU countries.
This was my... not exactly pleasant experience. Hope it is useful.

I just got Daueraufenthalt EG in Bonn. It costs 10 Euro and under AMMERKUNGEN field is written also : "$9 AufenthG (Daueraufenthaltsrecht EG)"
I'm romanian, I had greencard before, afterwards Niederlassungerlaubnis since March 2006.

I just went there asking for Daueraufenthalt EG and they gave it to me without asking me for additional papers or information.
I was there also 4 weeks ago when I had the page below printed:

At that time I was the first one asking for this kind of permit and they did not have the printed stickers, they did not even knew about it.
It seems that everything is ok now ...

in nürnberg/bayern where (where i live), they still do not give this title (DA-EG).
What would u recommend me to do in order to get it. Send the ABH a letter or just wait? I mean if i send them a letter, should they by law give me this title or is it determined by every state independently?
