explanation of AufenthG §104 (2).
Hallo,
I tried to follow the explanation of AufenthG §104 (2) for NE. It states that if someone is in germany before 01.01.2005, he is entitled for NE.
Does it mean working or having residence permit(student and paying RV).
In the clause it says having "Aufenthaltserlaubnis oder Aufenthaltsbefugnis ". is it similar to aufenhaltsbewilligung.

All you need is explained in §9 §9a §9b
Or else tell your situation in germany from the starting and some one can answer you

So here is the situation:
sep 2002 to april 2005 : aufenhaltsbewilligung
may 2005 to present : AE and now BE.
Am i eligible for D-EG or NE.

Answer is
Your are eligible for NE in May 2010
Your are eligible for D-EG around 1'st Quarter in 2009 because
1/2 Student time of 31 Months = 15 Months
Job = 35 Months
Total = 50 Months
You have to wait another 10 Months for your D-EG

There have been lot of remarks regarding counting half studnet time and number of years.I am not yet clear with it.
Can u calrify my case pls:
In Germany since 13 Nov 2003....
Working as Werkstudent since 24 April 2004
Permanenet Job since 1 Jan 2006.
Can u tell me when I am eligible for NE / DG .

You can calculate yourself
(1)Calculate the no of months as student and divide by 2
(2)Calculate the no of months as permanent job.
If (1) + (2) = 60 months then you are eligible for D-EG.
You can calculate from the difference, in how many months you are eligible for D-EG.
If you go for NE then you will need to work till Jan 2011 to be eligible.

I think this question is asked many times, but i did not understand the potential differences between NE and D-EG. Can you please explain.
If both has mostly same meaning then why the difference in issuing?
