India signs Social Security Agreements with Germany
Hello all,
Has anyone more info on the above topic? For example, when it says social security need not be payed:
(a) when does it actually come into effect? for whom, for those already here or for new comers?
(b) Social security payment exemption here menas to include all RV, KV and AV or only RV?

this will be valid if the Federal Govt. in Berlin approves. Mainly effective to people who come on company transfer.

Hallo Mr Kerwiss,
To further clarify on this issue:
1) Did this agreement come into effect?
Not yet! there are some legislative stuff needs to be done.
2) Does it benefits only those who are new comers?
Infact it was aimed at short term contract workers from either Nations. They are totally exempt from paying Pension Insurance. But they have to pay to their home nation.
3) Does it benefit those who have been living in Guest country for longer time and want to go back to their Home countries?
Yes, this agreement allows the individuals for portability of their pension insurance claims to their home country.

Yes, this agreement allows the individuals for portability of their pension insurance claims to their home country.
Does it mean, the agreement applies to all foreign nationals residing in germany even longer than say 5-10 years (with NE, D-EG).

Please find below the excerpts from Press Release of Germany Embassy in India
Germany and India sign an Agreement
on Social Security
On Wednesday October 08 the German
Government represented by State Secretary of the
German Federal Ministry of Labour and Social
Affairs, Mr. Franz-Josef Lersch-Mense, and the
Ambassador of the Federal Republic of Germany to
India, Mr. Bernd Muetzelburg, are going to sign an
Indo-German Agreement on Social Security. For
the Indian Government Secretary K. Mohandas of
the Ministry of Overseas Indian Affairs will sign
the Agreement in the presence of Minister Vayalar
Ravi.
This new Social Security Agreement will simplify
regulations on social security between the two
countries. It will protect the interests of all those
professionals sent from India-based companies to their
German subsidiaries, or those being sent by German
companies to India-based branches on the basis of
short-term contracts (up to 48 months with an option
of another 12 months extension) by securing
exemption from social security contribution in their
host country. While working abroad these employees
will only be subject to the social security regulations of
their home country. Thus, complicated changes and
applications for reimbursements will be avoided in the
future.
This Agreement is the result of an intensified
cooperation between India and Germany in matters of
social security. For the Federal Republic of Germany
the social security agreement will be in effect after the
official consent of both Houses of the German
Parliament.
Both sides are considering to also elaborate a
comprehensive Social Security Agreement comprising
of regulations concerning the exports of pensions, the
mutual recognition of entitlements, the totalisation of
contribution periods as well as a closer administrative
cooperation of the social security institutions of both
countries.
